Consent to Processing of Answers

Consent to the processing of data about private life: your answers to cards, your boundaries, and your couple’s data.

This is the English version of the consent form. The Russian original says the same thing. If the two versions differ, the one you accepted applies. Nothing in either version takes away the rights that the mandatory law of your country gives you.

1. What this is

This consent is given to the operator of Cerise when you check the box and tap the confirmation button on the first screen of the app or on the invitation screen. The box is not checked in advance. The consent is separate from the Terms of Use and from the consent to statistics and ad measurement. Without it the app cannot store answers and find matches.

2. Operator

Sergei Olegovich Afinogenov, sole proprietor (individual entrepreneur) registered in the Republic of Armenia, registration (tax) number 2408000572, address: Yerevan, Grigor and Sargis Gurzadyan str., 2, 0005. Contact: hello@cerise-app.com.

3. Who gives the consent

A user who has confirmed that they are 18 years old (or older, if adulthood begins later in their country). The app does not require a name, an email address, or a phone number, so the consent relates to the pseudonymous account identifier.

4. Consent

I freely, specifically, knowingly, and unambiguously consent to the operator’s processing of my data about private life — a special category of data — on the basis of Art. 9(2)(a) GDPR and the Armenian Law on the Protection of Personal Data, in the scope, for the purposes, by the means, and with the transfer to the persons stated below.

5. Data

6. Purposes

To show me cards within my boundaries; to find matches with my partner; to keep the couple’s history; to give me a copy of my data at my request. This data serves no other purposes and does not go into statistics. Only the fact that I gave five new answers goes into ad measurement, and only if I gave the separate consent in section 14.

7. Actions with the data

Collection, recording, storage, comparison with my partner’s answers, use for the purposes in section 6, transfer to the persons in section 8, and deletion. The operator does not publish this data and does not sell it. The content of my answers does not go into statistics or into ad measurement; only the fact of five new answers goes to the advertising side — Google — and only under the separate consent in section 14.

8. Who it is passed to

The data is not passed to anyone else; for the fact of five new answers, see section 14. The operator has technical access to the database, but does not open this data.

9. What my partner sees

Matches — cards where we both answered “Yes” or “Maybe” — and my answer in them; my name and gender, if I provided them; the text of a reward that I wrote. My partner does not see my “Never” answers, my answers without a match, or the list of topics I excluded. But some of it can be guessed:

More in the Privacy Policy, the section “What your partner sees”; I am familiar with it.

10. A new couple

If I link with a new partner, my “Yes” and “Maybe” answers — both those from before the link and those from my previous couple — will start working for the new couple: matches may appear from them right away. “Never” does not carry over to the new couple. The matches and history of the previous couple are not shown to the new partner. There is no way to choose “don’t carry over”: to start fresh, I delete my account before linking again.

11. Term

The consent is valid while my account exists, or until withdrawn. What the couple shares and the couple’s history are not available in the app to me or to my partner after a breakup, but are included in my data copy; they are kept until one of us deletes the account. An account that has not opened the app for 24 months (in a couple — if neither partner has opened it) is deleted with all its data, except accounts with an active Cerise Plus — bought by the person or received from a partner — and with a “Lifetime” purchase.

12. Withdrawal and its consequences

I can withdraw consent at any time by deleting my account in the app settings; the procedure is described on the page “Deleting your account.” The consequences:

13. My rights

I have the right to demand correction of the data, its destruction, and an end to processing; to get a copy of the data in the app settings; and to complain to a supervisory authority. The procedure is in the Privacy Policy, the section “Your rights.”

14. Statistics and ad measurement — a separate consent

This consent does not include statistics and ad measurement. A separate consent is provided for them: it is not turned on by default, does not hold up entry into the app, and the app works the same without it. By giving it, I give the operator a separate explicit consent to events about my use of the app, to crash reports, and to measuring the effectiveness of Cerise advertising — without answers, names, or card texts.

For ad measurement, the app on Android tells Google Analytics for Firebase two facts with no details: that I gave five new answers to cards and that I reached the end of the introductory setup. Together with them, Google receives an installation identifier, technical details about the device and the app, the country and region based on the connection address, and the install source — which advertising campaign and which tap on a Cerise ad it came from; the app does not collect the device’s advertising identifier. Google Analytics processes this on the operator’s behalf; Google Ads uses this information to assess and optimize Cerise advertising as an independent controller. Ad personalization is turned off. I understand that Cerise is an app about a couple’s intimate life and that the very fact of using it may reveal something about my private life; this is what I consent to when I allow this information to be passed to Google, including outside the EU. How transfers outside the EU are safeguarded is described in the Privacy Policy, in the section “Transfers of data outside Europe.”

I can turn it off at any time in the app settings: new information stops being sent immediately, and what was sent earlier is kept for the periods stated in the Privacy Policy. What exactly is sent and for how long it is kept is described in the Privacy Policy.

15. Record of consent

The operator records the time of the consent by the server clock, the kind of record, the editions of this text, of the privacy policy, and of the terms, my choice about statistics and ad measurement, the app version, and the platform, in order to prove the consent (Art. 7(1) GDPR and the Armenian Law on the Protection of Personal Data). The record is kept while my account exists, is deleted together with it, and is included in my data copy.

16. Changes

If this text changes, the app will ask me at launch to agree again and will not let me go further until I confirm; until then the earlier consent — to the earlier text — remains in force. I can delete my account, and thereby withdraw consent, in the settings right after I confirm. If the sole proprietor’s successor becomes the operator — for example, a legal entity — consent will be requested again: the earlier consent does not transfer to the new operator.
